These Terms of Use govern your (“the User”) relationship with the Bantry Market (“the Market”) Website (“the Website”) and your use of the Traders area of the Website (the “Service”). The Website Terms of Use also form part of these Terms of Use.

For the purposes of clarity use of the term Website, includes the use of the Service, for traders with access to the Service, except where specifically indicated by use of the term Service. The terms in the Traders Service – Terms of Use need to be taken as an addition to the Website Terms of Use. The Website Terms of Use can be found on the Website.

The Website and Service was created and is operated for the benefit of all traders at the Market by the Bantry Market Traders Association (“the Association”, “the Operator”, “we”, “us”).

The Market is regulated and run by Cork County Council (“the Market Authority”).

Please read them carefully as they affect your rights and liabilities under the law. You acceptance of these Terms of Use and use of the Feature, indicates your acceptance of these Terms of Use.

Use of the Service

The Service is provided to you for your use subject to these Terms of Use. By using the Service, you agree to be bound by these Terms of Use.

Amendments

We may update these Terms of Use from time to time for legal or regulatory reasons or to allow the proper operation of the Service. The changes will apply after we have given notice to registered users use of the Service and will be published by a suitable announcement within the Service or by email to their registered email. If you are a registered user of the Service and you do not wish to accept the new Terms of Use you should not continue to use the Service and remove your entry from the Website by de-activating it. If you continue to use the Service after the date on which the change comes into effect, your use of the Service indicates your agreement to be bound by the new Terms of Use.

Registration and Eligibility

To ensure that only traders at the Market can use the Service, registration is only available by completing the paper registration form. This form is available from a Committee member of the Association. Once completed, please return this to a Committee member of the Association. Details of Committee members can be found on the Association area of the Website.

Once we received your form, we will create an account for you on the Website. Access details for this will then be emailed to you, using the email address you provided on your registration form.

It is a condition of registering that you have received a Casual Trading Licence from the Market Authority. In addition, you agree to make your licence number and expiry date available as part of your data in the Service. This is required as part of the Casual Trading regulations for the Market.

You must inform us immediately of any changes to the information that you provided when registering by updating your details in order that we can communicate with you effectively. This includes your primary email address, market licence number and expiry date.

Password and Security

When you register to use the Service, you will initially be sent a password. This you should change to one of your choice after your first login. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should change it through the Service Change password facility. If for whatever reason, you are unable to do so, you should notify us by email at support@bantrymarket.ie.

If we have reason to believe that there is likely to be a breach of security or misuse of the Service, we may require you to change your password or we may suspend your account. This is to protect you and other users of the Service and Website.

Your use of the Service

You may not or not encourage, assist or enable others to use the Service for any of the following purposes:

  • Any of the points in the Your use of the Website section in the Website Terms of Use;
  • Promote a business other than your business holding a valid Casual Trading License issued by the Market Authority;

The Operator’s right to suspend or cancel your registration

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms of Use.

You can cancel your use of the Service at any time by informing us in writing at support@bantry.ie. If you do so, you must stop using the Service. In these circumstances, your account and information will be removed from the Service and Website.

The suspension or cancellation of your registration and your right to use the Website or Service shall not affect either party’s statutory rights or liabilities.

GDPR

By registering to use the Service, you are consenting and accepting that we may publish the information you indicate may be public in your data in the Service.

You are consenting to receive our support and help while you are a registered user of the Service.

If you wish to have your data completely removed and do not want to have your business and details included on the Website, please email support@bantrymarket.ie indicating this and we will remove your data and registration to use the Service.
